Texas NIL Laws

On May 28, 2021, Texas passed Bill 1385, allowing college athletes to profit from their Name, Image, and Likeness (NIL) starting July 1, 2021. Athletes can earn through sponsored posts, endorsements, and appearances but are prohibited from promoting products like alcohol, tobacco, e-cigarettes, anabolic steroids, gambling, illegal firearms, or sexually-oriented businesses.

Endorsement activities cannot occur during team practices or events, and athletes must avoid displaying university symbols during promotions. Additionally, athletes are required to attend financial literacy workshops, and all NIL contracts must align with university honor codes.

Student-athletes, universities, and businesses should monitor evolving NIL laws in Texas and nationwide. As regulations develop, brands can explore ways to support college athletes. While state laws vary, potential federal legislation could bring consistency.
